Right to Educational Leave for employees

In principle, any employee working in a federal state with educational leave regulations (the location of the workplace is decisive) or whose right to educational leave is regulated by collective agreements or employment contracts can claim educational leave for the legally specified duration. This also applies to unemployed individuals and part-time employees in certain federal states. Generally, every employee is entitled to five working days per calendar year as educational leave. The entitlement from two calendar years can be combined. The employer must be informed as early as possible, usually at least six weeks before the start of the measure, about the requested leave. The employer can reject the request if compelling operational or official interests or vacation requests from other employees are opposed. In this case, the educational leave entitlement may be transferred to the following year if necessary. Furthermore, all our educational measures are recognized according to § 9 of the Employee Training Law NRW.
